Geb A Ride Liability Agreement and Release

1. Nature of the Organization and Services

I explicitly acknowledge and agree that Geb A Ride is solely a peer-to-peer digital communication and community connection platform. Geb A Ride is not a transportation provider, motor carrier, common carrier, transportation network company (TNC), employer, principal, contractor, or supervisor of any driver.

• Drivers are independent community members participating on a strictly voluntary, favor basis.
• Geb A Ride does not employ, vet, background check, or supervise drivers, nor does it inspect, maintain, or guarantee the mechanical safety, roadworthiness, or insurance coverage of any vehicle used.
• Geb A Ride makes no representations or warranties whatsoever regarding the safety, punctuality, or completion of any ride.

2. Assumption of All Risks (Ordinary and Extenuating)

By requesting, scheduling, or accepting a ride through Geb A Ride, I knowingly, freely, and voluntarily assume all risks—whether known or unknown, foreseen or unforeseen—associated with traveling in another person's vehicle. This includes, but is not limited to, risks of vehicular accidents, road conditions, weather events, infectious disease exposure, physical assault, property loss, delay, and personal injury of any kind.

3. Comprehensive Release and Waiver of Claims

To the fullest extent permitted under New Jersey law, I, for myself and on behalf of my heirs, executors, administrators, assigns, and personal representatives, hereby fully release, waive, discharge, and covenant not to sue the volunteer driver, Geb A Ride, and its directors, officers, organizers, sponsors, employees, agents, contractors, successors, and affiliated volunteers (collectively, the “Released Parties”) from any and all liability, claims, demands, losses, damages, or causes of action arising out of or connected with any ride, including claims driven by ordinary negligence.

4. Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorney’s fees) brought by third parties, passengers, or family members arising out of my breach of this agreement or any actions or omissions on my part during the course of a ride coordination or execution.

5. Statutory Limitations and Non-Waiver

Nothing in this Agreement is intended to waive or limit any liability or rights that cannot legally be waived under New Jersey law, such as claims arising strictly from gross negligence, recklessness, or intentional/willful misconduct. If any provision of this release is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

6. Governing Law and Forum Selection

This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. I expressly agree that any legal action or proceeding arising out of or relating to this agreement or a ride coordinated through Geb A Ride must be brought exclusively in the state or federal courts located within the appropriate county in New Jersey, and I submit to the personal jurisdiction of those courts.

7. Dispute Resolution and Halachic Acknowledgment (ע"פ דיני תורה)

I acknowledge that this agreement is made under the jurisdiction of the laws of the State of New Jersey and, to the extent applicable, ע"פ דיני תורה (Al Pi Dinei Torah). I agree that in the event of any dispute, claim, or controversy arising out of or relating to this agreement or any ride, the parties shall first attempt to resolve the matter through good-faith dialogue. Should the dispute persist, such dispute shall be submitted to a Beth Din (Rabbinical Court) for binding arbitration in accordance with Dinei Torah. This commitment is made with the full intent of forming a binding obligation under both civil and religious law.

8. Additional Halachic Monetary Undertaking

9. Electronic Acknowledgment and Binding Effect

I have read this Liability Agreement thoroughly and understand all of its terms. I acknowledge that I am giving up substantial legal rights, including my right to sue. I confirm that I am signing or accepting this agreement freely, voluntarily, and without any inducement or coercion, and I understand that acceptance of these terms, both under civil law and ע"פ דיני תורה, is an absolute condition precedent to utilizing Geb A Ride services.
